Yes I Was Violated!!!

Recently, F.A.C.E.OFF. Movement was contacted by another victim of Government Corruption and Aggressive Code Enforcement Abuse in Apache County, Arizona. Here, in his own words, is his story:

Hello my name is Ray Longbons and I live in Apache County, Az. and I want to tell you a story. It involves my due process rights being violated by the Apache County Officials and I have come to find it has happened to every property owner ever sent a violation letter by the Apache County Officials. Neither myself or any other property owner was allowed a hearing before being found guilty of any violation and the county recording a cloud on our titles.

About 3 years ago, I decided to construct a steel barn building. I had the foundation dug and poured a concrete slab per a set of engineered plans a buddy of mine used for the same building over in New Mexico. I had all 4 walls up and part of the roof when a Apache County Official was spotted on my property taking pictures. About a week later I received a letter stating that I needed a building permit to construct my building.

That's when nothing started making any sense. I finished the building and then called the county. The girl in the office I talked too said I needed to come in and apply for a building permit. I went to St John's with my letter received and filled out the paper work for a permit like she asked me to do. The size, plans, plot as to where is was located on my property were given to them.

A few days later I received a call from one of the counties building inspectors. He asked a few question, but was not aware that the building was already constructed. When I made him aware that the building was already constructed, he said I would have to talk to Homer, the big boss.

After many phone calls I finally got through to Homer. He said I would have to get a variance on the constructed building, because is was constructed without a permit.

I WAS NEVER GIVEN A OPPORTUNITY
TO APPEAL IT!

A variance is quite a bit of work to obtain. Also it cost me $300.00 to obtain it. All land owners around the property had to be informed that the building was constructed without a permit. I had to go on the county internet site and get all names and addresses to give to the county so THEY could notify those owners.

I had taken pictures of all construction as I built the building, so I had a record as to how the foundation, slab, anchors in concrete were done. Homer asked me to get the Engineered Foundation Plans approved by his buddy at a engineering firm across the street. The plans were approved for a county in New Mexico that has a lots more snow load than in my area, but he said they had to be Arizona approved. I did as requested, $500.00 to stamp the prints,

17 copies of all photos, plans, plot, etc.had to be supplied to the County by me.
A lot of Work.

A letter was received by me as to when a Variance hearing would be held. The variance hearing gives local neighbors the right to object to the building. No one who was notified came to the meeting!

My property is located 7 miles north of the highway in on dirt and cinder roads. I own a total 30 acres adjacent. I attended the variance hearing, answered a few questions when asked to do so. The variance hearing was done telephonic with 3 or 4 people on their phones at home or work. They were to be the ones to decide on if the building was PROPER.

None of these people from what I have found out have any engineering degrees or actual building experience as contractors, however they were deciding on whether my building was constructed properly. Not the Building Dept!

The Variance was approved, but I was then told I would have to purchase a $600.00 building permit. That is when I said enough! A building permit is to build, The building was already

BUILT!
and APPROVED

by the
Variance Committee.

A few weeks later, A Apache County Assessor came out to my property to access the property. He was a very nice guy and ASKED if he could call my building a BARN! He said by calling it a barn, the tax rate would be a lot lower. He asked to see what I was doing with the Barn, I showed him I was storing all my garden tools, motorcycles, ATV's and collected junk in it. He said definitely it was a BARN. I then find out that I don't need a permit for a barn if it is on more than 5 acres.

Mine sits in the middle of my
20 acre property.

I THEN received a letter notifying me that if I didn't buy the $600.00 building permit, my property would be tagged with a code violation that would affect my properties value. I did not buy the permit, and they have tagged the property with the Code Violation and did NOT NOTIFY me that it was done!

NEVER GAVE A OPPORTUNITY FOR A APPEAL/HEARING,
HOW MANY TIMES HAVE I BEEN VIOLATED??????

Apache County Building does not know what they are doing! They have different rules for their buddies. I have been told a couple of Official's of the County have built similar buildings without permits and are using them not for barn purposes. Lets find out how they are being TAXED.

It's all about Money!!!!!!!!!!!

I now find out they didn't have the power to do anything that they have done.

Yes I was Violated!!!!!!!!!!!!!!!!!!!

The White Rose

In 1942, a group of students, and their philosophy professor, organized a non-violent resistance group to oppose Adolf Hitler in Germany. The group was called The White Rose. They launched a leaflet campaign calling for opposition to the dictator and his Nazi regime. One of their leaflets was smuggled out of the Country and, in July of 1943, Allied planes dropped copies of it across Germany. Also in 1943, the six core members of the group were arrested and executed by the German Secret Police. Today, the members of The White Rose are honored, amongst Germany's greatest heroes, for their brave opposition to Tyranny in the face of Death.

On July 15, 2010, Don Casey, Vice-Chairman of the Alliance for Citizens Rights, came down from Alabama to give a presentation about Sustainable Development, to the Citizens of Brevard County, Florida, at an event arranged by Barbara Knick, Brevard 912 Project Organizer, Penny Canales, Brevard County F.A.C.E.OFF. On April 15^th, 2009, three citizens of Brevard County, Florida, started a grassroots movement to expose and eliminate the aggressive and abusive Code Enforcement practices that are starting to take a stranglehold across Our Nation. As you can see from the following links, these practices are already well-entrenched:

Code Enforcement Working to Abolish Private Property

Note in the above article the reference to what they call the "illegal Kangaroo Court" where people who are being attacked by Code Enforcement are forced to pay outrageous fines to the Government, sometimes simply because an anonymous (and quite possibly completely unfounded) complaint has been made against them. Whatever happened to our right to face our accusers? How about innocence until proven guilty in a court of law? (Not at a quasi-judicial hearing where the magistrate may actually be a private real estate lawyer who can do whatever he pleases!)

We believe that alot of these practices are illegal, and they are definitely unConstitutional!

Our group is called F.A.C.E.OFF. (Fight Against Code Enforcement OFFice). In order to reach other citizens, we have picketed, passed out flyers, and gone door-to-door in neighborhoods. The response we have gotten, from the people we have talked to, has been tremendous. One evening, shortly after we formed our group, two of us spent 4 hours canvassing just half of one street in the June Park area of Brevard County. Once people started talking to us, and realized why we were there, they suddenly opened up and began to tell us their own stories. An incredible number of them had already been attacked by Code Enforcement, or knew someone who had. The stories they told us were heartbreaking chronicles of people whose lives had been ruined by abusive Code Enforcement. We even talked to a former Code Enforcement Officer, who told us that he was so disgusted by the things that went on behind closed doors in the department, that he quit the job! He said that the money wasn't worth it (despite the fact that the job was very well-paid) because of the misery that it caused and the corruption that he saw.

Do you really want this???
Do you really want the entire Nation to become a giant deed-restricted community where government officials drive around in their fancy, expensive, high-tech vehicles looking for code violations so that they can extort money from you? Stand up now, and draw a line in the sand, before little Johnny comes home from school, sometime in the not-to-distant future, with a note in his backpack that looks like this:

"Dear Parents: Please remember that this Friday will be Paint Chip Show and Tell Friday. Please make sure that Johnny brings in his paintchip from your house, so that we can be sure that your paint has not faded to a non-compliant color over Summer Vacation. Also, as I'm sure you are aware, we asked little Johnny to measure your lawn yesterday, and the grass is still too long, so your daily fine will now be raised from $25 to $50 until we can verify that you have come back into compliance. Sincerely, Your Friendly School Code Enforcement Resource Officer"

So what can we do?

OUR SIMPLE PLAN:

Step 1: Reaching the People Who Have Suffered

I have been able to gauge the interest of the people in our issue by holding up my picket sign, which says, “CODE ENFORCEMENT: TAXING YOUR FREEDOM TO LIVE” at various events. By doing so, I have discovered that many, many people have been harmed by and hate Code Enforcement. People have stopped me everywhere and asked about my sign. Then they have told me their own heart-wrenching stories about how they, or someone they care about, has been harmed by abusive Code Enforcement. As one old gentleman told a member of our group:

“It's not the stupid stuff they harass you about. It's the mental anguish they cause—the sleepless nights, the constant looking over your shoulder, never knowing when they will attack you again.”

By holding up my sign beside the road, I was able to get a very good idea of how Code Enforcement was viewed by the drivers going by. Some people slowed down to read my sign. When they saw the words, “CODE ENFORCEMENT” their eyes widened, as they craned their heads to read more. Some turned around and drove back, so that they could read it again. One group stopped in a turn lane and asked me if they could photograph the sign. Hundreds of them either honked repeatedly, raised fists out their windows, shouted, waved, or gave me the thumbs up. Some of them would realize, after they passed me, what the sign actually said, and would begin to honk furiously to let me know that they agreed. These are the people we need to reach. These are the people who know what Code Enforcement in Our Country has become: An aggressive, abusive, illegal, unConstitutional way for the government to extort money from frightened citizens.

Step 2: Letting Our Government Officials Know How We Feel

In our quest to find out how our citizens' group could make ourselves effective in bringing about change, we tried many different things and talked to many politicians, and local government officials, to ask them for advice. Most of them agreed that the only way that things can be changed is for us, We the People, to convince our Government Officials that we, their constituents, do not want abusive Code Enforcement. Once we have reached the people who have been wronged, and who are suffering, because of Code Enforcement, we must put pressure on our Government Officials, by calling them and meeting with them, to make them aware of how we feel about abusive Code Enforcement and make them aware of the pain and suffering it is causing for the people that they were put into office to serve!

My name is George Walsh and I thought I would share my site with you. As the ultra vires actions of Zoning enforcement officials is out of control and needs to be stopped for all property owners...I have worked alone to try and get folks to standup but many have forgotten what rights they have and so many more never knew. And I each and everyday work to educate the property owners in my area and send emails to groups all over the USA. I have been working to get every county in Arizona to have a related group so we could all share information and work on the larger state issues when needed...I just thought if more groups shared information we could win some of these battles...

But for now in Apache County I work on the property rights issue alone for the most part. But many are taking part just in smaller ways from behind the scenes. Many are afraid to be public or to speak out against the evil empire of GOOD ole boys here in Apache County. I have often called this county way of doing thing as the Dukes of Hazzard county and their ordinances were the speed trap. Never legally adopted nor legally enforced. But yet for 25 years they have been enforcing what was never adopted. And every single property ever given a violation was denied all due process before being found guilty and having a cloud recorded against their property. With no way to defend the alleged violation...

I want them to know who is standing up and not taking it any more...I have attached a picture of me from when I was planning a run for county supervisor. It was to be my effort to end the abuse. But I instead supported a Republican and he lost by less then 200 votes. And just so you know I was also threatened by these public officials if I kept looking into what they were doing...I had to stop going to meeting for fear of being set up or arrested.

I am and have been looking for a lawyer and have had no luck but I am still hopeful I will find one and be able to take this case to court... I have been looking for Constitutional rights lawyers for ours is a civil rights violation as well as a property rights violation. And I figured I might have a better chance in that area and use it to expose the zoning enforcement problems. I have had to think outside the box. I many times look for laws they have violated and put them on notice of their own violations.

The small wins I have are they stopped recording new violations last Sept 2009 and have not recorded any new ones. And they have sent at least one violation letter that was somewhat legal. But it has gone nowhere as they are starting to understand they were wrong but will never admit that.

published in the Douglas Dispatch,
on Saturday, September 5, 2009:

"Code Enforcement Officers have begun to issue notices to residents regarding weeds and property maintenance. If you have not received a notice as of yet, and you see that you have weeds in your yard or other nuisance violations such as; un-screened storage of personal property, inoperable vehicles in your yard or on the street, or weeds and trash in the City’s public right’s of way (the areas between your property line and curb/edge of pavement) which includes but it is not limited to the front or side of your property and the alleyways behind your property, we respectfully ask that you get these areas cleaned before any enforcement action is taken."

What You Can Do to Help Eliminate Abusive Code Enforcement

CALL YOUR GOVERNMENT OFFICIALS
If you want to eliminate Abusive Code Enforcement practices, the first step will be to convince your Government Officials that their constituents do not want the tactics that are being used, so if you feel strongly about this issue, or have been personally harmed by Code Enforcement, please call your Government Officials and let them know how you feel. Tell your Government Officials about what has happened to you, or to someone you know, and how your life or theirs has been hurt by it. Note: Please be sure to talk directly to each Government Official (not to their staff). If you are told that a Government Official is not available at the time that you call, please ask to schedule a time when you can call back and talk directly to the Government Official. After you have talked to your Government Officials, please send an e-mail to faceoffmovement(at sign)yahoo.com (Use the @ on the keyboard.) Let us know what each Government Official told you about the issue and how you felt about the results of your phone calls. That way we can get a good idea of how your Government Officials feel about the issue of reforming Code Enforcement.

VISIT YOUR GOVERNMENT OFFICIALS IN PERSON
Even more effective than calling your Government Officials is going to visit them in person. If you feel strongly enough about the problem of aggressive, abusive Code Enforcement that you are willing to meet with your Government Officials in person, please call their offices and make appointments to come in and tell your Government Officials face-to-face about the problems you have experienced with Code Enforcement. Note: One of the biggest weapons that Abusive Code Enforcement uses against people is their feelings of fear, shame, and isolation after they have been attacked. Knowing that many others have been attacked and are willing to stand up with you eliminates that weapon.

We have found that it is always best not to go in alone to talk to Government Officials unless you have experience in doing so. Here is how you can arrange for others to accompany you:
ORGANIZE YOUR NEIGHBORHOOD
Go door-to-door in your neighborhood and talk to your neighbors. You will probably be surprised at how many of them have also been attacked by Code Enforcement and will be willing to go in to visit Government Officials and complain with you. Code Enforcement tends to target neighborhoods and write up many people in one area at the same time. One resident we worked with told us that when two of his neighbors got into a dispute, and one of them reported the other to Code Enforcement, Code Enforcement Officers came into his neighborhood and wrote up nine houses on his block in order to "be fair" to everyone. Let your other neighbors (who haven't been attacked yet but probably will be soon) know about the abusive Code Enforcement practices going on in your area and across Our Nation. Ask them to call and visit your Government Officials with you. If you contact us before you go door-to-door, we will send you a flyer that you can print out and links to stories (locally and in other States) about abusive Code Enforcement. You can then have that information with you to convince your neighbors that action needs to be taken before things get so far out of hand that nothing can be done to stop the abuse.

SPEAK OUT AT COUNTY AND CITY/TOWN MEETINGS
Go in person to your Local Government Meetings, fill out a Public Comment Card, and Speak Out. Tell your story in front of the Government Officials. Arrange for other people in your area to come in with you to Speak Out also or to witness you Speaking Out. That way there will be friendly, supportive faces in the room which makes Speaking Out much easier and much more rewarding.

CONDUCT AN E-MAIL CAMPAIGN
If you would like to help our movement from the comfort of your very own home, you can be of great value without ever leaving your computer. We will send you a full-color flyer in PDF format and some very convincing links that you can send to everyone in your e-mail contacts list. Ask them to read the information and forward it to everyone they know and ask them to call their Government Officials to register their opinions on the subject of Abusive Code Enforcement. Also, please ask them to contact us for further information and to let us know the type of responses they have received from their phone calls to their Government Officials.

GET DIRECTLY INVOLVED
There are many things you can do if you would like to be directly involved and become part of a Grassroots Movement to reform Government at the local level and improve the lives of your friends and neighbors by making Arizona a place where Government serves the people and the people are not afraid of the Government. Alot of these things will not take up very much of your time but will be very valuable in helping us get the word out. Our aim is not to take up your time, but rather the time of the Government Officials who can do something to change the Abusive Code Enforcement practices. We want to make them aware of the issue and the suffering that Aggressive Code Enforcement is causing so that they will be highly motivated to make the changes that are needed. We want these Government Officials to cringe every time they hear these words, just like the rest of us do:

"Code Enforcement!"

Here are some of the things you can volunteer to do to help:
*Speak Out to Organizations or Groups you belong to or know about on the issue of Aggressive Code Enforcement Abuse.
*Organize a Neighborhood by going Door-to-Door.
*Be a Contact Person for your District or City/Town to help organize your area.
*Accompany other Citizens who want to complain in person to Government Officials and want a Witness to come with them.
*Work with Frightened Older People who have been attacked by Code Enforcement to help give them Comfort and Support and to help them tell their stories to the Government Officials.
*Be part of a Demonstration or Picket Line to draw attention to the issue of Aggressive Code Enforcement Abuse.
*Pass out Information Flyers in Public Places around your area.
*Tack Information Flyers to Bulletin Boards in Public Places around your area.
*Be a News Googler and find Code Enforcement Abuse stories to post on this Blog.
*Write up a Post for this Blog about your own story of Code Enforcement Abuse.
*Write up a Post for this Blog to tell the story of someone you know who is not good at writing but has been attacked by Abusive Code Enforcement and wants their story told.
*Help us contact people you may know who are Experts on the Constitution, Constitutional Law and other legal matters related to our issue and who would be willing to talk to us and give us Information and Advice.
*Help us start an Internet Buzz about the issue of Aggressive Code Enforcement Abuse.
*Contact us with all of Your Great Ideas that we haven't even thought of yet!
